Hire AgreementFor collection in store the hire period is 2-3 days. For example, if you collect in store on the Friday or the Saturday after 2 pm the outfit is due back on Monday before 2 pm. If collecting mid-week, the hire period is 2 days i.e. collection on Monday the refund day shall be Wednesday. Longer hire periods can be arranged at an additional cost. If you would like to have your outfit delivered we take into account that your outfit must be delivered in advance. If you select to have your outfit delivered on the Thursday the collection will be on the Monday as our couriers do not work at weekends. A Friday delivery would also be collected on the Monday. If you select a mid-week hire the collection would be 48 hrs after the delivery i.e. delivry on a Tuesday would therefore be collected on the Thursday. Longer hire periods can be arranged at an additional cost. Goods are hired to the customer on the understanding that they shall be returned in an undamaged and reasonably used condition (do not attempt to wash) and the customer shall be responsible for and indemnify us against any loss or damage to the goods while on hire. Customers are advised to check immediately after collecting the hired goods that they are complete, are the correct sizes and are in good condition. We cannot be held liable for any loss of profit or any indirect or consequential loss suffered by a customer. A £20.00 BOOKING deposit is payable at the time of booking and is credited against the hire. This deposit is non-refundable. The additional SECURITY deposit of £20 is payable on collection or before delivery however, this will be refunded. The security deposit is over and above the hire cost. If picking up from our shop garments are available for pick up from 2 pm, an early collection can be arranged at £5 per outfit. Outfits are to be returned by 2.00 p.m. on the stipulated return date. The return date is the date from which charges will arise for late returns. If you return your kilt outfit after 2 pm on the return date you will forfeit your £20.00 deposit. For both pick up and delivered outfits, Kilt outfits returned 1 day or more after the stipulated return date will be charged at a rate of £20.00 per outfit per day. There will be no exceptions. The customer accepts full responsibility for all items hired to my party and in the event of loss or damage or theft they agree to pay for the full replacement cost and any standing charges against the hire levied by the hire company. The customer shall read and understand the Full Terms and Conditions (below) and understand that they can obtain a written copy of this upon request. Delivery TermsFor online bookings: If you place your order online we shall contact you for your credit or debit details. Your card details shall be used to verify your address and a £20 returnable deposit shall be charged. The deposit shall be refunded to your card when the outfit is picked up on the agreed date and returned to our warehouse. For delivery: A £20.00 security deposit is payable before we release your outfit. This deposit will be refunded if the goods are returned in good condition and on the stipulated return date. If you would like your outfit delivered and picked up we shall use our courier. Within the UK, you can expect delivery on the date specified by you, 'The Hirer' on your order. Deliveries to the UK Islands and the Highlands take 2 working days however, this additional delivery time will be allowed for. The Highlands and Islands incur higher delivery charges. All Kilt Hire orders consisting of one complete outfit to be delivered to mainland UK (which includes postage, packaging materials, order processing costs and collection on completion of the hire period) are only £25.00 for one outfit; any additional outfits will be charged at £19 per outfit (includes postage, packaging materials and order processing costs). The delivery cost includes return delivery of the outfit. Failure to have your outfit ready on the agreed date shall incur late charges. If unsure of the pickup date please contact us at 0141 336 6514 (Glasgow). Please contact us for a quote for all UK Islands, Northern Ireland and Rep. Ireland delivery and packaging costs. Please note: The price charged for delivery and collection of any item includes the cost of postage, packaging materials, return delivery and order processing costs and the postage price seen on the package is only a part of these costs. Outfits and suit covers are to be returned in the original delivery box. The box you receive your items in must be used for return delivery. There shall be cable ties attached to seal your box. The boxes are to be sealed with the provided cable ties. Failure to close the box may result in damage or loss of items and in turn, you will be held liable to pay the replacement cost. Please make sure the box is sealed. For any reason the outfits are not made available for pick up, the outfits shall be charged at £20 per day and possibly a charge for any extra pick up arrangements. Unfortunately, some areas of the UK are subject to a remote area charge. If your address falls into one of these areas we shall contact you and on a rare occasion, we may have to increase the delivery charge. If you believe you may live in a remote area please contact us and we can confirm your postage charge. Full Terms & Conditions of HireThis contract states the terms & conditions by which we, A1 Kilt Hire ('The Supplier') agree to provide you, ('The Hirer') with hire wear. All garments remain our property at all times and are provided for the duration of the hire period stated on the hire agreement or as agreed with you verbally over the telephone at the time of placing your order. It is your responsibility to take reasonable care of the garments. Please check your order when it arrives, any missing or incorrect items must be reported on the pick up or delivery date. CANCELLATIONS Our cancellation period is 60 days. Any cancellations that take place 60 days or more BEFORE your collection/delivery will receive a refund of the rental amount MINUS the £20 deposit/restocking fee. If you cancel within 60 days of your collection/delivery no refund will be given.For the avoidance of doubt, if you cancel 60 days before you receive your order you will be entitled to the amount minus the £20 deposit/restocking fee however if you cancel 59 days before you receive your order, you will not be entitled to a refund and no exceptions can be made CHANGING YOUR ORDER We offer a 48hr window after the initial order is placed where customers can make changes to their orders at no cost. ANY CHANGES AFTER THIS 48 HOUR PERIOD EXPIRES WILL BE CHARGED AT £9 PER CHANGE IE for the avoidance of doubt - If after 48 hours of an order being placed the customer wishes to make a change (as an example) the size of jacket and the colour of socks the fee for this would be 2 x change fee of £9 = £18. payment must be made before any changes are confirmed. DELIVERIES TO HOTELS/AIRBNB/THIRD PARTY ADDRESS If you elect to have your items delivered to and/or collected from a Hotel/Airbnb/accommodation (or any Third party address) you must ensure they are willing to both take delivery AND make available for the courier the items for collection as the customer is responsible for any delays or losses incurred if the courier is unable to deliver or collect from the accommodation/third party address due to refusal, lack of access or the items not being available or similar. ONLINE PRICES MAY VARY FROM IN STORE PRICES. 1. Garments a) We do not accept responsibility for the fit of garments if orders have been completed incorrectly. All telephone orders will be read back to you as we enter them onto our system. It is your responsibility to check these details are correct, as we do not accept liability for telephone orders after we read them back to you. However, we will attempt to replace any garment to give you the perfect fit. b) We reserve the right to substitute the size of any of the Garments in the order to the nearest half size. We reserve the right to substitute a tartan with a comparable tartan should the preferred tartan not be available in a specific size. c) We reserve the rights to substitute a Tartan with a comparable colour match should the preferred tartan not be available in a specific size. 2. Deliveries a) We do not accept responsibility for any failure to deliver by any third-party carriers. 3. Care of Garments & Accessories a) You agree to treat the garments and accessories with reasonable care. b) You will be responsible for the safe keeping and safe return of the garments from such point as the garments are delivered into your care and until they are returned to us. c) You will not modify or alter in any way those garments in accordance with the order and you will become liable for all payments and charges made by us in rectifying and/or replacing such garments which are modified. d) You agree to notify us immediately of any loss or damage to the garments once you become aware of such loss or damage and be liable to us for the full replacement/repair costs. We will notify you of other losses/damage not notified to us and charge you the full replacement/repair costs. We reserve the right to charge you for damages, loss or late returns before consulting you. e) Please be advised that the skean dhu is a replica of the real blade and cannot be removed from its sheath. f) As the Skean Dhu is a decorative accessory only, we do not accept any responsibility for any damages, costs, claims, losses, expenses or liability whatsoever incurred by us, and howsoever arising as a result of misuse of the Skean Dhu, you will indemnify us for any such damages, costs, claims, losses, expenses or liabilities. You agree for the purposes of the Unfair Contract Terms Act 1977 that this liability exclusion is reasonable in the circumstances. In the event that this condition is deemed unenforceable, that shall not affect the validity or enforceability of any other provision of this contract, it being the intention of you and us that all conditions of this agreement shall be valid and enforceable. g) You agree as an obligation surviving termination of this agreement to indemnify us in respect of any claims made against us and all damages costs and expenses suffered or incurred by us as a result of any third-party claim arising out of the garments or in any way arising out of the garments being let under this agreement. h) We reserve the right to charge for any garment and/or accessory which is lost or stolen as these are not covered by the Accidental Damage Waiver; a full list of charges can be found in our 'Price List' in the appendix. i) Suit covers and bags are loaned at no extra cost but are subject to a surcharge of £15 and kilt hangers at £10 each if not returned or if returned damaged. 4. Return of Garments a) All garments and accessories picked up from the shop must be returned by 2 pm on the stipulated return date. Delivered garments shall be picked up on the day stated on your paperwork when delivered. Pick up usually occurs 3 or 4 days after delivery, please contact us prior to your hire if unsure of the pickup date. Please do not hire an outfit if you shall not be at the given address between 8.30 am and 6.30 pm on the day of delivery and pick up. The return date on the hire agreement stated is the date from which charges will arise for late return. Overdue returns will be charged at a rate of £20.00 per outfit per day. In no instance will a hire exceed 60 days. Delivery boxes must be returned. 5. Accidental Damage Waiver a) Should you choose to pay a premium of £10 per outfit for Accidental Damage Waiver we will waive any charges that would normally arise following accidental damage to any of the garments, provided that they are being used appropriately, up to the value of £200. If the Waiver is not paid we reserve the right to charge you for any costs for replacement or damages. b) The waiver does not cover garments which have in our opinion been damaged through inappropriate use. f) We reserve the right to charge for any garment and/or accessory which is lost or stolen as these are not covered by the Accidental Damage Waiver; a full list of charges can be found in our 'Price List' under ' New Prices'. The damage waiver will not apply to kilts that are returned soiled. 6. a) A £20.00 deposit is payable at the time of booking and is credited against the hire. This deposit is non-refundable. A £20 security deposit will be charged however this is fully refundable over and above the hire cost. b) Your authorization is mandatory (required at the time of booking) that in the event of non-returned or damaged garments (unless Accidental Damage Waiver cover is taken) that we are authorised to deduct the full replacement value of the garments directly from your credit or debit card. c) Your hire can be cancelled and cancellations are subject to a £20 cancellation fee for each outfit. If you wish to cancel your order within 60 days of the hire, no refund shall be given. d) Please note that a £10 fee is added to your hire cost if your booking is made less than 48 hrs before the pickup date. e) Credit card charges are at no point refundable. 7. Proof of Identification a) You must supply two forms of identification in order to collect the hire. One form must contain your photograph and one must contain your current residential address. Suitable forms of identification are as follows: · Current Passport; or · Driving License; plus · Utility Bill; or · Council Tax Demand Failure to do this will result in our withholding the hire until suitable identification has been shown. 8. Appendix * Accessories can be added to any package.
